What is the Data Act?
The EU Data Act refers to Regulation (EU) 2023/2854, which provides data portability rights to customers of digital services in the European Union.
Who can exercise rights under the Data Act?
Notion customers located in the European Union can exercise rights under the Data Act.
If you are a customer located outside of the European Union then the Data Act does not apply to your contract.
What rights do I have under the Data Act?
The Data Act allows Notion customers located in the European Union to, among other things:
• Switch to a Data Processing Service of the same service type as Notion • Switch to an On-Premise ICT Infrastructure • Erase their Exportable Data
How can I exercise my rights under the Data Act?
EU Customers can exercise their rights to Switch services or to erase their Exportable Data under the Data Act by:
• Executing a valid Data Act Addendum to their Master Services Agreement or Personal Use Terms of Service, and • Then submitting a valid Data Act Switching Request Form to Notion support.
To obtain a Data Act Addendum to your contract, please contact Notion's support team. The process for submitting a Data Act Switching Request Form is explained in the Data Act Addendum.
What is a Data Act Addendum?
The Data Act Addendum is a legal document incorporated into your contract (i.e. Notion's Master Services Agreement or Personal Use Terms of Service) that outlines the terms for customers' rights under the EU Data Act, particularly regarding data portability and switching between service providers.
To obtain a Data Act Addendum to your contract, please contact Notion's support team.
How much notice do Customers have to give of their intention to exercise their rights under the Data Act?
Customers have to provide Notion with 60 days' notice of their intention to exercise their rights under the Data Act by submitting a valid Data Act Switching Request Form to Notion.
Switching
What if I have a fixed-term Subscription and want to Switch before it ends?
You can still Switch services in the middle of your Subscription Term under the Data Act even if you have a fixed-term Subscription.
How long should the Switching process take once it is initiated?
The Switching process should take no more than 30 days once it has been initiated after the 60 day notice period. If for some reason it will take longer than this, Notion will inform you and extend the Switching period accordingly.
Can I extend the period for Switching myself?
Yes, if 30 days is not long enough, you may contact Notion support to extend the Switching period on a one-time basis for a period that is more appropriate.
What assistance will Notion provide during the Switching process?
Notion will provide reasonable assistance through its self-service export feature and API access, which are free of charge. These Export Features will allow you to access your Exportable Data in a structured, commonly-used and machine-readable format.
Where can I find information about Notion's Export Features?
Please see information about Notion's self service export feature and access to Notion's API. These Export Features are both provided free of charge. These allow the export of your Exportable Data in PDF, CSV, or HTML format.
What happens after the Switching process is over?
After the Switching process has concluded your contract with Notion will automatically terminate.
How long can I access my data after the Switching process?
You may retrieve your Exportable Data for a period of thirty (30) days after the Switching process has ended.
Can a third party submit a Switching request on my behalf?
Yes, a Request for Switching may be submitted by a third party authorized by you, but the Request must include proof of your authorization.
Erasure of Exportable Data
What happens after I request to erase my Exportable Data under the Data Act?
Your contract with Notion will automatically terminate sixty (60) days after Notion receives and verifies a valid request from you to delete your Exportable Data.
When does Notion delete Exportable Data after I submit a Data Act Switching Request Form for erasure of my Exportable Data under the Data Act?
After you delete your workspace(s) using the self-service workspace deletion feature available here, Notion will ensure full deletion of all of your Exportable Data.
Charges
Can Notion charge any fees for Switching?
Notion may charge Switching fees for any Switching Request made before 12 January 2027. This is explained in more detail in the Data Act Addendum.
Can Notion charge any fees for terminating my contract under the Data Act?
Where customers terminate their contract with Notion under the Data Act, Notion will charge an early termination fee equal to the Subscription Fees that would have accrued until the end of the agreed Subscription Term.
Technical Questions
Where can I find the transparency information that Notion is required to provide under the Data Act?
Notion provides transparency information on Exportable Data, Switching procedures, data residency and technical specifications in Notion's Documentation, DPA and Security Standards. This is explained in more detail in the Data Act Addendum.
What data is portable under the Notion Data Act Addendum?
A customer's workspace is considered Exportable Data under the Data Act Addendum. The workspace contains data inputted into Notion by a customer as well as data generated by a customer through their use of Notion.
Exportable Data includes certain metadata about your workspace as well as Input and Output from Notion AI.
Does Notion have any Digital Assets for customers to port?
No, Notion does not have any Digital Assets of customers.
What tools does Notion make available in order to facilitate Customer Switching?
Notion provides its self service export feature and access to Notion's API, both free of charge, to allow the export of Customer content in PDF, CSV, or HTML format.
What data is excluded from the Switching process?
"Exempted Assets/Data" as defined by the Data Act are not applicable to Notion's Switching process.
Does Notion delete Exportable Data after Switching is complete?
Yes, Notion confirms the data deletion period in the Data Act Addendum, provided that the Customer takes action to delete their Notion Workspace using the self-service workspace deletion feature available here.
Can Customers continue to use Notion after initiating a Request to Switch?
Customers can use Notion during the 60 day period after they have provided notice to Switch, and for 30 days during the Switching process. Customers can also still access their data for a 30 day Retrieval Period after the Switching process is over. After the Retrieval Period, Customer's contracts with Notion and their access to Notion will terminate.
If Customers would like to reactivate their contract with Notion or back out of Switching, they should contact their Account Executive to discuss.
What measures can Customers continue to use Notion after initiating a Request to Switch?
Customers can use Notion during the 60 day period after they have provided notice to Switch, and for 30 days during the Switching process. Customers can also still access their data for a 30 day Retrieval Period after the Switching process is over. After the Retrieval Period, Customer's contracts with Notion and their access to Notion will terminate.
If Customers would like to reactivate their contract with Notion or back out of Switching, they should contact their Account Executive to discuss.
What measures does Notion take to prevent international governmental access to EU data?
Technical, organizational, and contractual measures to prevent international governmental access to non-personal data held in the EU can be found in Section 3.10 of the Notion DPA, Annex II of the Notion DPA, and the Notion Security Standards.
